Cincinnati, OH (AHN) - Cincinnati Bengals wide receiver Chris Henry can't seem to stay out of trouble. Already suspended for the first half of the 2007 NFL season, Henry made himself one of the poster boys for the NFL players' behavioral problems on Monday when it was revealed that he failed his mandatory, court-ordered drug test and will have to serve 88 days in a Kentucky jail.

 

According to Kenton County (Kentucky) Attorney Garry Edmondson, Henry tested positive for opiates and now will be sentenced to jail time for the second time in a year.

 

WKRC-TV in Cincinnati first reported on the troubled wide receiver's most recent bewildering legal episode.

 

This is also the second legal incident involving the legal-challenged Bengals over the weekend. Linebacker A.J. Nicholson was arrested for the second time in a year when he was booked for domestic assault on Friday. Police alleged that Nicholson punched a woman he was living with during a domestic dispute. Nicholson was arrested last year, just before the NFL Draft for burglary when he broke into Florida State teammate Lorenzo Booker's house and stole stereo equipment while working with former teammate Fred Rouse.

 

Nine Bengals have been arrested over the last year and a half, some of them like Nicholson and Henry, have multiple legal offences on their rap sheets.

 

Henry has been arrested four times since December 2005 and is currently on probation in Florida for carrying a concealed weapon outside an Orlando nightclub.

 

No word yet on if he could serve jail time in Florida for the violation of his probation.

 

Herny's arrest in Kentucky stems from an incident where he permitted minors to consume alcohol in his hotel room. He served two days in prison for that indiscretion.

 

This may be it for Henry in the NFL for awhile as he has exhausted commissioner Roger Goodell's patience. When Goodell chose to suspend him for the first eight games of the 2007 season, he told Henry in a letter, "I must emphasize to you that this is your last opportunity to salvage your NFL career," Goodell said. "I urge you to take full advantage of the resources available to support you in that effort."

 

Henry had been permitted to work at the Bengals' camps in the offseason, however, he won't be allowed to participate in team practices during the regular season.

 

A statement is expected sometime in the afternoon from the Bengals in reaction to Henry's latest debacle.

Well, at this point, you'd probably have to say that this guy has zero control over his actions, and I wouldn't be surprised if his NFL career is over. I don't know that I'll ever be able to understand people like this.

But you also have to look at what Goodell said: "I must emphasize to you that this is your last opportunity to salvage your NFL career." He clearly isn't going to exercise a lot of patience when it comes to Chris Henry...and Chris Henry isn't deserving of anyone's patience.

 

Let's say they extend to a year...you're talking 16 months or so before this guy steps on a football field again, and I don't see him staying out of trouble for 16 months. I really think he's finished.

I'm guessing they'll bump it to a year.

Very well could be true. Hopefully he will realize that he has to clean his act up when there are no pay checks coming in for the first 8 games (or whatever it turns out to be). If not then he will probably get in trouble again and be out of the league.

The agent for suspended Bengals receiver Chris Henry denied a report that his client failed a court-ordered drug test.

 

"The final result is negative," Marvin Frazier told the Cincinnati Enquirer. "It's all [nonsense]." Frazier also told ESPN.com's John Clayton that the test was negative.

 

Kenton County (Kentucky) Attorney Garry Edmondson said Monday that Henry tested positive for opiates and he will be forced to serve 88 days in jail. However, Edmondson's office later backed off that statement and said it was awaiting the results of a second test.

 

Frazier told ESPN.com the second test, whose results came back either late Friday or early Monday, turned out to be negative. Henry's attorney said the first test, which was not administered by the NFL but was court-mandated, was comparable to a home pregnancy test.

 

The Bengals said Monday that they were awaiting more information on Henry from authorities in Kenton County, Ky.

 

A spokeswoman for the Kenton County attorney's office said there would be more testing in the Henry case.

 

"We know that there are inconsistent reports about the routine drug screenings," said spokeswoman Melissa Pryor-Reed. "As a result of these inconsistencies, further tests are currently pending."

 

After reports circulated early Monday that Henry had failed a drug test, the chief prosecutor for Kenton County said authorities were waiting for final analysis from the Kentucky state lab.

 

"We have to wait for confirmation from the state lab. We have suspicion on a field test," Ken Easterling told The Cincinnati Enquirer. "We cannot confirm or deny [Henry's test sample] contains a controlled substance."

 

Failing a drug test could result in Henry's current NFL suspension of eight games being extended to at least a full season. He could also face more jail time in Kenton County.

 

The Bengals issued a statement Monday, saying: "For Chris Henry to return playing NFL football, the Bengals understand that he must comply with certain legal and NFL-related procedures. To date, to the Club's knowledge, Chris has been complying with those procedures, and the Club is not aware at this point of any circumstance in which Chris has not complied with his obligations.

 

"With respect to the Northern Kentucky proceedings, reports to date may not be based on complete information. More information is expected to be made available shortly, once all the procedural tests are complete, and the Club will await any action until that information has been released."

 

Henry is permitted to work out at the Bengals' facilities in the offseason and participate in training camp, including preseason games. He won't be allowed to practice with the team when the regular season begins. He will be reinstated after the eighth game if he stays out of trouble.

 

"I must emphasize to you that this is your last opportunity to salvage your NFL career," NFL Commissioner Roger Goodell wrote Henry when he suspended him. "I urge you to take full advantage of the resources available to support you in that effort."
