The Third District Court of Appeal in Miami shot down auto dealer Norman Braman’s efforts to block public funding for the Florida Marlins stadium.

 

The appellate court ruling upholds Braman’s loss on all counts of his lawsuit challenging the use of public funding for the stadium after a Miami-Dade Circuit Court trial in July 2008.

 

In the lower court ruling, Miami-Dade Circuit Judge Jeri Beth Cohen declared that the county’s receipt and use of revenues in absence of a voter referendum was constitutional.

 

Braman questioned whether the stadium represented a paramount public purpose and whether a larger funding agreement between the city, county and Marlins was constitutional.

 

Officials from Miami-Dade County, the city of Miami and the Florida Marlins officially broke ground on the $640 million project this past summer on July 18.

 

County Mayor Carlos Alvarez said in a press release that the ruling “ensures that we will continue to move forward in a positive direction, creating opportunities for businesses, residents, and visitors.�

 

In the past, Braman had promised to take the case as far as the Florida Supreme Court. But Paul Huck, one of the lawyers who represented Braman, said they are evaluating the court ruling and he declined to say whether they would appeal.

 

With a capacity of approximately 37,000 seats, the retractable roof, air-conditioned ballpark will be built on 928,000 square feet on the former Miami Orange Bowl site. Opening Day is expected in April 2012.

I wholeheartedly agree with this sentiment.

 

He had a right to sue, he did, and he failed. Now he should just do everyone a favor and go away. Two courts have found absolutely nothing illegal about the stadium deal. An appeal to the Florida Supreme Court would be a gigantic waste of time and money. Not to mention that by the time it ever got heard and ruled upon the stadium will be complete.

Gotta agree here. It was his constitutional right to do what he did whether we here liked it or not. Now it's time to take his losses and move on. It's over. Heck, it's been over. We can all show our displeasure with him in our own ways. I opt to not give his companies money if I can avoid it. I doubt he misses the cash my company would have spent with him, but it makes me feel better.
