October 20, 200421 yr Anyone who knows anything about how the law works will know this case wont get to court. It will be struck down on summary judgment because of the principle of assumption of risk as accepted by the ticket. Of course the papers never report this and people never follow up so the crisis continues when it really doesnt. And the coffee girl was an old conservative Republican women named Stella Liebeck who, after recieving high degree burns, contacted McDonalds and asks for an apology and minor medical expenses and was refused. A McDonalds official also testified that they knew full well their coffee was well higher than average fresh brew coffee and could cause higher degree burns, recieved many complaints, but decided it wasnt worth spending the money to tell employees. But whats even funnier is Ms. Liebeck had her award drastically reduced by nearly 100% upon appeal so McDonalds didnt pay anything. But like this case, the media didnt follow up and people continue to use anecdotal evidence. Its interesting..if you cross reference economic downtrends with demands for tort reform..they correlate pretty well. In fact evidence shows the rate of lawsuits pretty much hasnt been massively increased over the last few decades.
