The team, city and county need to convince the state legislature in the spring to give the Marlins a state sales tax rebate that would provide $30 million toward construction costs. But first, a law must be changed that limits the rebate to eight professional teams. The NBA's Orlando Magic, which has struggled to put together a deal for a new arena, is supposed to be the eighth beneficiary of the rebate. State legislators have said the Marlins appear more organized to get the rebate than last year. But the Marlins likely need to finalize a deal with the city and county before the state considers giving the team the $30 million. We have to wait until they get up there in March. But if the Magic don't get their business cleaned up, the Marlins could slide into that 8th slot and force the Magic to get the law changed. The Governor says he backs the plan and the leaders of both houses say they like what they see from early indications. ? For months, the city and county have asked the Marlins to specify how they would pay for cost overruns, through either a letter of credit or other firm guarantees. ''That is the holdup,'' Miami city manager Joe Arriola said. Miami-Dade County tax collector Ian Yorty, said the Marlins said they will consider giving the county a lien on the franchise -- which would allow the county to sell the team if the Marlins default on payments. ? The Marlins have asked for an additional $17 million from local government to cover land acquisition near the Orange Bowl and additional infrastructure costs. ''We're still working on the land,'' Burgess said. Land still has to be worked on because it has to planned, zoned, and bought properly. This is more an issue of time than money. $17 million is quite a bit, but remember the tax rebate is for $60 million in total for the team.
