And if we're talking about a life term then it's a moot point. But in this case the killer was recorded back when he was arrested in '91 (for touching a little girl), saying that he needed help so he wouldn't molest a kid again, & didn't think his 2 year prison term was going to do him any good. I'm not saying he honestly wanted help, the guy is clearly a demented and sick f*ck. And he obviously never actively went out & sought treatment himself. But I don't want to just hope that demented sick people will seek help for their twisted problems, I want to try & at least make an effort to fix them (if such a thing is possible) while they're serving a sentence. Otherwise, if you are jailing a convicted child molester for 2 years, what reason do you have to hope he'll be any different when he gets out? The deterrence idea is overvalued anyway. Maybe a clear-thinking mind weighs the jail time of a sick evil act like that before he commits it. But if he were a clear-thinking rational individual he wouldn't have done it in the first place.

This particlar guy needs to be distinguished before the arm chair folks get up in arms. 10 years ago he put his hand over a girls mouth and tried to kiss her. Yeah its sick and yeah its perverted but you cant get pissed off because the state didnt execute him or put him away for life back then. At least, knowing they couldnt do anything to him long term, they tried to rehab him. Its terrible that it didnt work but short of keeping a cop on him constantly, nothing could really happen. Child molesters are sick f***s who get everything they have coming towards them but its a stretch to attack the justice system on this one.
March 28, 200521 yr MarlinsContinueTo ShowDominance makes a valid point that both rehab and deterrance have both been relativley ineffective, though rehab perhaps less so but less funded. Unless we are willing to execute all first time offenders of crime, its pretty well known that our modern prison system breeds greater violence. It also facilitates gang activities. Its easy for politicans to say stuff to appease people who want to lock em up and throw away the key. But thats not always feasible. If anything, society needs to start caring how prisons are run and be willing to invest in improvments in the prison system. Quite frankly, they are overburdened, underfunded, and badly run because people dont care as long as thats where "those people" are.
March 28, 200521 yr Personally, I think that deterrance is the least effective method. Clearly criminals aren't fazed by the threat of the death penalty, otherwise crime would have dropped when we first started executing criminals.
March 28, 200521 yr What hotcorner is talking about isnt really rehabilitation by itself. Its a mixture of rehab with incapacitation. Right now the prevailing models in this country are retribution and rehabilitation. Rehab is attempted but fails, b/c you cannot rehba every single offender and b/c attempting to do so is too expensive. The solution is to minimize penalties for many drug offenses. This will reduce overcrowding and we cna focus more on getting the sick f***s some help.
