11th Circuit Court Rejects Schiavo Appeal

Wednesday, March 23, 2005

TAMPA, Fla. ? The 11th U.S. Circuit Court of Appeals (search) in Atlanta has denied a request by the parents of Terri Schiavo (search) to reinsert the severely brain-damaged woman's feeding tube. The three-judge panel ruled 2-1 to deny the request, a day after a federal judge in Florida rejected a similar appeal.

This is not the end of the line. Look for more tax payer money to be used in more appeals. I think you can call this "court shopping" at this point.

You know as well as I do that this case has been destined to be heard by the supreme court since the summer of '03

I guess the courts are basically saying that Terri is "owned" by her husband. Gee that's sad since he wants her dead and her family wants to help keep her alive. They raised her and loved her and took care of her growing up and they have NO say. I lost my sister to cancer and her husband was a real jerk who didn't give two craps about her either. He just wanted her DEAD ASAP. :(

This is a very personal struggle...it is very easy for someone who is detached from the situation to make a rush to judgement. Thanks for sharing your insight. I too have some questions about the husband in this case.

At least the courts haven't been rolling over to the wishes of Congress so far.

Right b/c you disagree with what congress did. This is going to end up being overturned simply b/c the SC doesnt want to lose any power to congress. It has become an issue of speration of powers. However, congress did what it could and so did bush to please the social conservatives. So i nthe end the repubs will strengthen support from their social conservative base.

well i guess legally she technically is.

just like her husband would be 'owned' by her if the shoe were on the other foot.
