November 20, 200915 yr Technically, Logan Morrison should be on the 40 man roster as well pursuant to his 2005 draft status. Believing that there is absolutely no way the Marlins messed that up, the only plausible explanation I can come up with is the 2007 draft and follow rules are not retroactive to the 2005 and 2006 classes. Basically, pre 2007, when a team drafted a high schooler, didn't sign, and went to a JUCO, the team retained their draft rights for the entire year up till the next year's draft. Logan did this (he enrolled into Comm. College), then the Marlins signed him in 2006 (lucky for us) before the next draft. This distinction - drafted 2005, signed 2006 - could be construed as making Logan more like 2006 High school draftees because of the year they signed in. Thus making Logan, 40 man property for next season and not this one. (Only 2006 college players need to be protected this year, why Sinkbiel is above). So in case anyone is wondering why random NNY/myself/other posts about the 40 man have included Logan and the Marlins didn't protect him, it's not because they don't care about him. I'm guessing the non-retroactivity of the new draft and follow rules is the reason.

November 21, 200915 yr Silly question, but say if we make a trade and get rid of Uggla and we don't get anyone back in return who has to be on our 40-man straight away (unlikely), can we still add to our 40-man (Raynor) before the Rule 5 draft?

Sure. The 40 man deadline is basically to establish rights for some players who may need to start the free agency period. It's so teams can't just hoard guys if they have no intention on using them. Guys can certainly be added if roster space is cleared.
