June 23, 200422 yr http://www.fmqb.com/Article.asp?id=29015 Now fines can be up to 3 million dollars a day and be given DIRECTLY to the person who speaks, not just the company. The problem? The fines are selective, people like Oprah and ect failed to get fined for the same exact things Howard gets fined for. Furthermore, these fines can be retroactive, so a show 6 years ago can be digged up and then charge howard with fines. Furthermore, all of this curiously happened just 1 week howard publically stated he was against Bush and the gay marriage ban amendment. Right now, a man's voice is being stopped because of POLITICS. This is such a violation of the 1st amendment, it is not funny. Even if howard changed his enitre show to just politics and no "filth" (which is selectively allowed for other non-political people), retroactive fines would punish him anyway. This is so f*cking ridiculous. I wish I knew how to do something about it.
June 23, 200422 yr Someone will come along and challenge this because it's unconstitutional. All it takes is someone with the gumption and a radio station with balls. I don't know if Stern is the guy to do it anymore, he seems content to rest on his laruels and oogle strippers, but you never know. Perhaps you should write Stern a letter about this, granted he might already know, but I'm sure the Oprah comparison COULD piss him off enough to do something about it.
June 23, 200422 yr Author He knows about oprah, check this out on howardstern.com: http://www.howardstern.com/oprah.html someone does need to bring this to the supreme court.
June 23, 200422 yr another thing that is bad about all this is that they can redifine indecency and then go back and dig up an archive and fine it on modern standards the radio industry (and howard directly) are getting screwed by this seriously, they should have a set list of things that cannot be talked about (the 7 dirty words, etc), set it in stone and let broadcasters know clearly what they can and cannot broadcast if you cannot provide clear rules, don't get pissed when they get broken the fcc is shameful on many angles my belief is to educate the people about the product and let them decide whether or not they want to consume it I wouldn't buy an NWA CD and complain that i'm being subjected to violent lyrics, I wouldn't buy a metal CD and complain that I'm offended by the guitars and I wouldn't willingly listen to a radio show and complain about content that is a known factor seriously people, turn the dial and get a life
June 23, 200422 yr The FCC is not subject to being sued because it has immunity. It is a regulatory agency, if you do not follow it's rules, you will lose your license. Howard could always clean up his act or move to satellite radio. I do not know why you guys see this as new, they are finally enforcing the laws that have been in the books for a long time, modernized obviously, but ignored by the Clinton administration. I'd hate see what happens if they start enforcing the proper language only rule. The Saint Louis Cardinals and KMOX Radio would have some comments from the past. :lol
June 23, 200422 yr Dizzy Dean was the man who made the FCC tired of regulating the proper language rule. The indecency rule has always been around, and up until the Clinton administration, enforced. It is the same principle as the written language in public. If someone puts up a billboard with indecent language they could be fined and forced to remove the content if reported. The FCC recieves complaints, investigates, and dishes out the fines when it is found to be in violation of laws and regulations. These shock jocks keep acting like thier freedom of speech is being taken away, it is not. You can say it, but be prepared to bleep out the things that are indecent, go to satellite/internet radio, move to overnight, or get out of the business.
June 23, 200422 yr Your congressmen wrote the laws, the FCC enforced them. That is how our government works. Legislative writes the laws, Executive enforces them.
June 23, 200422 yr With all due respect capefish... What is inmoral and indecent has various definitions and different interpretations. Someone may think that playing fart sounds is inmoral and therefore push a fine on such a DJ that plays such joke on his counterpart. Don't you think that "indecency" is a very grey area? What is offensive to you is hilarious and entertaining to me. I find Rush Limbaugh to be an offensive indecent bigot... Maybe we should put the same fines on him.
June 23, 200422 yr This is the standard for "defining" obscene: An average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; The material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and The material, taken as a whole, must lack serious literary, artistic, political, or scientific value. Very broad and it surely violates the first ammendment.
June 23, 200422 yr Lcyberlina, I know you are liberal and try to constantly attack conservatives, but let's look at the issue. Stern played a segment in which racial slurs illegal if said on the streets of New York and most other cities, was fined for it, and is now crying about his perversion.

Get informed and then we talk.

Very broad and it surely violates the first ammendment. It has been around in one form or another since the 1930's and has survived some very liberal congresses and administrations. Stern broke the law, got caught, and got his company fined. Mind you, this was the same station group (CBS/Infinity) in New York that had to blow up their WNEW-FM station due to airing a live sexual act inside of a Catholic Church in New York City.
June 23, 200422 yr Earlier, he had wondered if he should even talk about the controversy. "I could blow my stack, but ... ," Stern said, trailing off. "A caller used the N word, and I hung up on him." Stern was referring to his Tuesday morning interview with Rick Salomon, Paris Hilton's ex-boyfriend and the man involved in her infamous sex video. A person called in during the interview and used a racial slur. http://www.cnn.com/2004/SHOWBIZ/News/02/25/stern.suspension/
June 23, 200422 yr alot of his stations did not run him on delay and therefore could not bleep it out. Now because of this, even MRN (NASCAR radio) is on delay.

I do not know why you guys see this as new, they are finally enforcing the laws that have been in the books for a long time, modernized obviously, but ignored by the Clinton administration. No, they made a lwa where they can sue the broadcaster PERSONALLY. Furthermore, the leeway in INTERPRETATION allows the FCC to attack political opponents and this is exactly what the FCC is doing. Are they going after oprah? Hell no. Howard was fined for saying the word "titties" for god sakes and if you ever listened tot he show one of the only things they CAN get away with is saying racial slurs (ironically.) Get educated. Read my first post instead of pumping wild assumptions out of your arse.

Artie is regularly called a guinea wop, Robin is called a n****r, Howard is called a hook nose...none of this is bleeped and none of this results in fines. the word "titties" does.
June 23, 200422 yr alot of his stations did not run him on delay and therefore could not bleep it out. Now because of this, even MRN (NASCAR radio) is on delay. dude, is it really necessary to post 3-4 consecutive times with a few minutes delay between each post every time you decide to post in a thread? *googles* *posts* *googles some more* *posts again* *googles some more* *posts again* *googles some more* *posts yet again* what fun is a messageboard discussion if it's just some rote exercise in googling? why not take a few minutes to compose your thoughts (and look up facts if necessary), and then post your feelings in tune with the discussion at hand? if you find some valuable information through google a few minutes later, you can just edit your post and append it to the bottom. it's nuts to have to read 9 posts just to get one poster's perspective in a thread as small as this. does it really take that many chronicles of one's trips to google to validate one's point?
June 23, 200422 yr racial slurs aren't illegal anywhere if a DJ spins a record that has slurs on it do you fine the DJ and the artist who produced it? do we go back and fine a tribe called quest for making a track called "sucka n****s"? the definitions are very grey and not enforced across the board everything in there is a grey area, especially when you start to considering artistic aspects also stern wasn't spouting slurs ...... a caller said some stuff

I do not think in one thought if you haven't noticed yet Alkazoid. I spit it out as it comes to me. That is why when I sit down to write a composition, I must be left alone for a long period of time. Not my fault I am interrupted doing something else that I cannot devote enough time to argue something that I don't really care about.
June 23, 200422 yr i read a column from the early or mid 90s that NYC was trying to make a "bigot police" of sorts...and were trying to make it illegal to use racial slurs....I have no idea if it ever went through, but I would assume that it would have an EXTREMELY tough time getting passed.
June 23, 200422 yr Furman, in Florida they can ticket you for using foul language in public...of course no one enforces it.
