Braman was shut out in summer 2008 in his legal attempt to force a public referendum on the use of public money to help build the $609 million ballpark and parking structures and his belief that $50 million in bond referendum money could not be used toward construction without a public vote. The auto dealer lost on all counts to the county, city and team. He appealed. Tuesday's oral arguments before the three-judge panel will be heard at the law school at Florida International University's main campus on Southwest 107th Avenue and Eighth Street. Each side will be given 10 minutes to state its case in a hearing scheduled for 9:30 a.m. No ruling is expected for weeks. I really just want this A-hole to go away. Either way, the construction is underway and Braman has no chance of winning this case on appeal. I hope when he loses again in court, the Marlins, County, and City sue him to re-coup their court costs.

According to the news clip yesterday, Braman wasn't even there, just his lawyer. Probably because he knows he has no case. Samson was there though.
September 2, 200916 yr I was going to say that I didn't understand how Braman had standing in a case like this, but then I found this under the Wikipedia entry for 'standing (legal)': In Florida, a taxpayer has standing to sue if the state government is acting unconstitutionally with respect to public funds, or if government action is causing some special injury to the taxpayer that is not shared by taxpayers in general. So I'm guessing that's the argument he's making, that it's an illegal use of tax funds. It's still stupid, since the stadium deal had to be approved by multiple governing bodies.

Not only that, but what else could the stadium funds go towards. Not much else right? It's tied into the bill passed that said a certain amount has to go towards public debt for certain entertainment buildings(i believe). AKA, the opera house, AAA, and others.
September 3, 200916 yr There is no way in hell that Braman will win this. The judge that decided the case a few months ago was very careful and deliberate, even waiting for the State Supreme Court to settle a relevant case before she made her final judgement. She knew that the decision would automatically be appealed by Braman or the Marlins, so she made darn sure to make a decision that would not be overturned. This is Braman's last ditch effort that he is forced to make in order not to look like a quitter. I am not worried at all.
September 16, 200916 yr *yawn* When is this old guy gonna die already? It wont go away for a while... braman's going to get a bill at the end of all this. It'll be the County's, States, and Marlins fee's for lawyers. No amount of cars will make up for that. I bet he goes to bankrupcy when everything is said and done.

Eventhough the Marlins, county and city will not waste any more time on this toolbox, they should recoup the court costs anyway. I still think Braman is doing this to keep his name and ugly photo out in the public so people will go buy his crappy cars.
