Two Central Michigan University football players, including Mid-American Conference first-team running back Jerry Seymour, have been charged with murder in the fatal beating of a 26-year-old man during a fight outside a bar. A third player and a female student also were arraigned on charges in the July 2004 death of Demarcus Graham, Isabella County Prosecutor Admin Burdick said. Seymour, 20, a junior from Miramar, Fla., and Spencer Lewis, 23, a junior running back from Lathrup Village, were arraigned Tuesday on one count each of second-degree murder, involuntary manslaughter, assault with intent to do great bodily harm and perjury, Burdick said. Defensive tackle James Edward Cooper Jr., 22, a fifth-year senior from Detroit, was charged with two counts of perjury, one count of obstruction of justice and one count of being an accessory after the fact. Cora Lee Hawkins, 20, a sophomore from Detroit, was charged with one count of perjury. All four were arrested Tuesday. Trial Judge William Ervin set bond at $1 million on the second-degree murder charges facing Seymour and Lewis and $100,000 on all other charges, the Morning Sun newspaper of Mount Pleasant reported Wednesday. Burdick said in a statement that the investigation into Graham's death has not concluded. But, asked during a telephone interview from Mount Pleasant if more arrests were forthcoming, he said, ??The grand jury has a couple more weeks of work to do, and I can't comment.'' All four suspects were being held Tuesday evening in the Isabella County Jail. Burdick said he did not know if they had retained attorneys, but if they had not done so by Wednesday or Thursday it was likely lawyers would be appointed for them. Graham, of Mount Pleasant, was beaten unconscious outside Shaboom's Pub during a fight on June 25, 2004. He died 19 days later at St. Mary's Hospital in Saginaw. Isabella County Chief Judge Paul Chamberlain appointed himself the lone grand juror in September 2004 at Burdick's request. The prosecutor requested the grand jury after police said witnesses interviewed about Graham's death were being uncooperative or lied. Chippewas coach Brian Kelly indefinitely suspended Seymour from the football team on April 1, two days after he was charged with criminal contempt on accusations he lied to the grand jury. Seymour pleaded no contest and later served 30 days in jail. Kelly said Tuesday that Cooper and Lewis also have been indefinitely suspended. ??I have a great deal of faith and trust in our judicial system,'' Kelly said in a statement. ??These young men will be given the opportunity to have a fair trial, and because of our system of justice, are innocent until proven guilty. However, as student-athletes, they are held to a higher level, and will remain suspended until further information becomes available.'' Four other students, including two former football players, also were charged with criminal contempt during Chamberlain's investigation. Each served 30 days in jail, Burdick said. Contempt charges against former player Anthony Rogers are pending, the prosecutor said. ??The CMU community was very saddened, and I was personally sickened, by the death of Demarcus Graham as a result of violence. Such acts do not represent who we are and the value we place on one another,'' university president Michael Rao said in a statement. ??The university is extremely disappointed that CMU students have been charged in this incident. Their alleged behaviors are inconsistent with the values we hold as a university.'' The 5-foot-5, 190-pound Seymour ran for 1,284 yards last season and had 47 receptions for 413 yards, earning him a spot on the All-MAC first team. He rushed for 1,117 yards in nine games in 2003, when he made the All-MAC second team as a freshman. Lewis started Friday's game against Indiana, rushing for 6 yards on 7 carries and catching 1 pass for 8 yards in a 20-13 home loss. Because the charges were brought by a grand jury, the suspects were bound over for trial without a preliminary hearing, Burdick said. Ervin scheduled pretrial conferences for Sept. 13.

The Washington Nationals activated right-hander Jon Rauch from the 60-day disabled list before Tuesday night's game against the Florida Marlins, and moved infielder Junior Spivey from the 15- to the 60-day DL. Rauch was 1-3 with a 4.00 ERA in eight relief appearances this season before being sidelined in May with a torn right labrum. He had shoulder surgery May 31. ??Hopefully, I can fill in, eat up some innings and just help out,'' Rauch said. ??To bounce back this quick, especially after surgery, is exciting.'' He allowed one run and three hits in three innings in a rehab appearance with Triple-A New Orleans on Monday. Tuesday's action Lastings Milledge hit two home runs and Brant Ust drove in four runs with a homer and a two-run single Tuesday in the United States' 11-1 victory over Spain in baseball's World Cup. The United States (3-0) leads Group B, just ahead of Nicaragua (2-0), which beat the Czech Republic 1-0 on Anibal Vega's solo homer. In Group A, Yuliesky Gourriel hit a two-run homer in the first and a leadoff shot in the fifth to pace Cuba to its fourth victory, 15-0 over Sweden. The Netherlands also improved to 4-0 with a 7-0 victory over Brazil. The top four teams in each group will advance to the Sept. 14 quarterfinals. Ust hit his two-run single in the fifth to give the Americans a 5-1 lead. He added a two homer with one out in the seventh that was followed by Milledge's second and another by Ben Zobrist to end the game on the game on the 10-run mercy rule. Mike Cervenak also homered for the Americans, who outhit the Spaniards 14-4. Jared Wells allowed one run and four hits through six innings for the Americans. In other games, Edgar Velazquez hit a two-run homer in the seventh inning to lift Puerto Rico to a 6-4 win over Taiwan. Taiwan led 4-3 in the sixth inning on a three-run shot by Kuo Chun Yu. Puerto Rico improved to 3-1, same as Japan, which beat Colombia 12-0. Tsutomu Takanezawa and Daisuke Kusano hit three-run homers and Yoshikazu Doi gave up just four hits over seven innings for Japan. Keiji Ikebe also homered for Japan. For Cuba, Eriel Sanchez keyed an eight-run sixth inning with a three-run homer. Panama remained a game behind as Carlos Munoz's RBI double highlighted a three-run fourth and led a 5-4 victory over China. Canada improved to 2-1, beating South Africa 12-1 on homers by Geoff McCallum and Joey Votto.

  9. Jason Giambi doesn't play for the A's anymore but that doesn't mean he's forgotten about the friends he made while playing here. When the Yankees' first baseman heard that Oakland third-base coach Ron Washington lost two homes ? his own and his mother's ? in Hurricane Katrina, he immediately asked to join the A's players who were raising money to help Washington. Giambi, who played in Oakland from 1995-2001, donated $20,000 to help Washington in his quest to find housing for 16 relatives who were forced out of New Orleans last week and have taken refuge in Alabama. ??They pretty much lost everything,'' Giambi said. ??I just felt (the donation) was something I wanted to do. He's a great man.'' The A's players donated about $9,000 and when Washington heard about the size of Giambi's contribution, he tried to tell Giambi it was too much but Giambi insisted. ??That's the way Jason is ? he's a class act,'' Washington told the San Francisco Chronicle. The coach, who fought back tears when he was told about the donations, has also reportedly told other players who offered contributions that he's received enough help and they should donate to charities dedicated to helping other affected families instead. Giambi said he spent a lot of time working with Washington and credited him for helping to refine his powerful swing. Joe Torre wasn't surprised to hear about Giambi's generosity.

  11. Lloyd McClendon was fired Tuesday as manager of the Pittsburgh Pirates with the team only one defeat away from a fifth consecutive losing season. Bench coach Pete Mackanin is set to serve as interim manager for the rest of the season. The team is expected to immediately begin searching for a replacement for McClendon, a former Pirates player and coach who was on the verge of becoming the first manager in team history to have five consecutive losing seasons. The Pirates have not had a winning season since winning the NL East in 1992. The talent-thin Pirates, who only this season began a concerted effort to rebuild with youth, averaged 91 losses in McClendon's first four seasons. With a 55-81 record going into Tuesday night's game against Arizona, they were tied with Colorado for the NL's worst record. The Pirates held a club option on McClendon for 2006 and, after an encouraging start that saw them reach .500 at 30-30 on June 11, the team began talking to McClendon about next season. But the Pirates have since lost 51 of 76 games and appear headed for their fourth season of 90 or more losses since 1999. The Pirates have lost four straight, nine of 10 and 14 of 18. They also have dropped eight in a row at home, their longest streak since PNC Park opened in 2001. Once they lose another game, the Pirates' 13 consecutive losing seasons will be three short of the major league record. This move is kind of a surprise as late in the year as it is but i guess the Pirates front office (GM Dave Littlefield) and company need a head start in looking for a new manager
  12. San Francisco 49ers lineman Thomas Herrion died from heart disease when he collapsed after a preseason game in Denver on Aug. 20, the Denver County coroner said Tuesday. Herrion had ischemic heart disease, with significant blockage in his right coronary artery that caused the death of heart muscle, the city health department said in a news release. Herrion's heart was slightly enlarged. Drug screens on Herrion's blood and urine found only atrophine, a drug administered when medical personnel tried to revive him. Herrion, 23, was pronounced dead early on the morning of Aug. 21. The 6-foot-3, 310-pound guard was on the field for San Francisco's 14-play, 91-yard drive that ended with a touchdown with 2 seconds left. Players had finished listening to coach Mike Nolan address them in a postgame meeting when Herrion collapsed. Medics administered CPR on him and took him to an ambulance that rushed him to a nearby hospital. About three hours later, 49ers spokesman Aaron Salkin confirmed that Herrion had been pronounced dead.

  17. Wide receiver Freddie Mitchell, who helped the Philadelphia Eagles get to the Super Bowl last season, had his contract terminated Friday by the Kansas City Chiefs. The outspoken Mitchell, who had 22 catches in the 2004 regular season and seven more in the playoffs, had been released by the Eagles in March and signed with the Chiefs. But a knee injury kept him from appearing in any exhibition games and he was released the day before all NFL teams must cut their rosters to 53 players. He said he will undergo arthroscopic surgery on the knee in hopes of being able to join the team. The Chiefs also signed Thomas Barnett, a free-agent tackle, to a two-year contract and waived Aaron Johnson, a second-year guard from Ball State. Source: AP

The Albuquerque Isotopes have set a record for highest attendance in a season, with 582,839 fans enjoying Isotopes baseball in 2005, surpassing the previous season high of 576,867 set in team's inaugural year of 2003. The record brings the team's three-year total to 1,735,313, further evidence of the community's continuing love affair with its baseball team. The club began the year strong, drawing 10,201 fans for Opening Day and never looked back, attracting more than 10,000 fans for a game 13 times, including 10,001 in the season finale. On July 4th, the ?Topes welcomed the largest crowd ever to see a baseball game in Albuquerque as 14,744 fans flocked to Isotopes Park. Three weeks later, the ?Topes set a three-day attendance record by welcoming 38,052 fans for a weekend series on July 29-July 31. Of the team's top 10 single-game attendances, five were achieved in this year alone, including two of the top three, and three of the top five in team history. Last year, the Isotopes followed up their historic 2003 campaign with another great year at the turnstiles, drawing 575,607 fans. Over the ?Topes' three-year existence, the club has averaged 8,185 fans per game, with an average of 8,209 people attending Isotopes games in 2005.   21. Sidney Ponson's third alcohol-related incident since December has prompted Major League Baseball's Baltimore Orioles to release the 28-year-old right-handed pitcher. Ponson was arrested a week ago on a drunken driving charge and spent 11 days in a jail in Aruba in January. The American League club plans to terminate his contract, set to run through 2006, for violating clauses with his drinking. Ponson was charged with driving under the influence and driving while impaired near here last Thursday after being pulled over by police for tailgating. In January, Ponson was charged with drunken driving in Florida in a case still pending. Ponson had been jailed for allegedly punching a judge in a fight, but reached a settlement for community service and a charitable contribution. Ponson, who has not pitched since August 7 due to a torn ligament in his right thumb, is 7-11 with a 6.21 earned-run average this season. The Orioles tried to trade Ponson, who has a 76-91 record in eight major league seasons, to San Diego in July for Phil Nevin but the Padres' hurler used a no-trade clause in his contract to doom the deal.   22. Greece pulled out of the baseball World Cup for financial reasons Thursday and will be replaced by the Czech Republic. Greece withdrew on the eve of the 18-team tournament after federation president Panos Mitsiopoulos claimed its expenses were not being met. ??We have not received any state subsidies in 2005,'' Mitsiopoulos said. ??It is impossible for us to cover our own expenses. Our employees have not been paid for months.'' The World Cup features mostly amateurs or players on reserve squads of professional clubs.The Netherlands will face China in the tournament opener on Friday.   24. The Florida Marlins purchased the contract of Jeremy Hermida, their top pick in the 2002 amateur draft, from Double-A Carolina on Wednesday. Hermida hit .293 with 18 home runs and 63 RBIs in 118 games with Double-A Carolina this season. He takes the roster spot vacated by right-handed pitcher Chris Resop, who was optioned back to Carolina on Tuesday. ??I wish I wasn't late on my first day of BP,'' Hermida said Wednesday as he hurriedly dressed to take part in major league batting practice for the first time. Hermida's role, for now, is expected to be almost entirely as a reserve, either a pinch-hitter or pinch-runner. ??It gives us another left-handed hitter off the bench who can at least hit the seats,'' Marlins manager Jack McKeon said. ??And he's a pretty good runner.'' Hermida, who has been slowed by a sore wrist ? the result of an awkward slide about a week ago ? stole 23 bases in 25 attempts for Carolina this season.
  25. Third baseman Sean Burroughs rejoined the San Diego Padres for the stretch drive on Wednesday, 5? weeks after being demoted to Triple-A to try to regain his batting stroke. Burroughs, whose average had dropped to .255 when he was sent down to the Portland Beavers on July 23, will be used as a pinch-hitter and to give third baseman Joe Randa an occasional rest. ??I'm excited. There's no guarantees or anything,'' said Burroughs, the Padres' first-round draft pick in 1998. Burroughs caught a 6:30 a.m. flight from Tucson, where the Beavers played Tuesday night. ??I couldn't get here quick enough,'' he said before the Padres played an afternoon game against Arizona. To make room for Burroughs, right-handed reliever Paul Quantrill was designated for assignment. Burroughs batted .290 with three home runs, eight doubles, 14 RBIs and 21 runs in 32 games with the Beavers. With the Padres, he had just one homer and 15 RBIs in 78 games. ??It's always hard to leave a team, especially when we were doing so well,'' he said. ??But you can read the fine print sometimes. You can kind of feel stuff as an inevitable thing. It was definitely the best decision the Padres could have made. I had a great time.'' Burroughs was sent down the same day the Padres acquired Randa from the Cincinnati Reds for two minor leaguers. Randa has hit .242 with three homers and 10 RBIs with San Diego. He hit a go-ahead homer in Tuesday night's 7-5 win over Arizona, which gave the Padres a 5?-game lead in the NL West and pulled them to one game below .500 at 65-66. The Padres tried to trade Burroughs earlier this season, but ended up optioning him to Triple-A. Burroughs, the son the son of former AL MVP Jeff Burroughs, has shown a remarkable lack of power, hitting only 11 homers since he made his big league debut in 2002. Burroughs said Beavers hitting coach Jose Castro and roving minor league hitting instructor Rob Deer helped him work on his swing. ??It's the best I've felt in years,'' said the left-handed Burroughs, who worked on pulling the ball. ??It's a confidence thing. It carries over day in and day out. It was probably the hardest .295 I've hit. I probably only had three, four hits to left the whole time I was down there, which I'm excited about.'' Quantrill made 22 appearances, going 1-1 with a 3.41 ERA.
