Not if it went down the way it has been publicized. Anibal was completely in the wrong. Telling the team he wasn't feeling any discomfort, etc... He tried saying he was going into Fredi's office to tell him he was feeling some pain the day the demotion happened (yea...right...) but then didn't say anything until a couple days after his demotion and on the day (or day before) of his first start at AAA. If that's the way it really happened then this is just a technicality by him and his agent to try to get the most they can while he sits at home. He should lose, IF things went down the way we were told. Just looking at the evidence presented they will have a hard time proving the club knew he was hurting.

Had the club known he was hurting, he wouldn't have been sent down to AAA. He lied and got caught.

 

I hope he loses his claim and learns not to lie.

Sanchez might have made an error of judgment in not telling the Marlins that he was injured, but if he did so, he did it with the intention of trying to help the team. This represents the 3rd instance where a player has been injured and the team hasn't been able to diagnose it (De Aza, Johnson). Also, in the cases of De Aza and Sanchez, the player has been afraid to inform the team that he's feeling discomfort. Why is that? That points to a serious problem in communication.

 

Take this information, coupled with the fact that the team has been riddled with injuries across the board, and it tells you that the Marlins have a significant problem with their training staff. Rather than point the finger at the players, I'm more inclined to blame the Marlins for a near-negligent medical staff that has been unable to properly maintain players, foster communication with their players, nor diagnose injuries when they occur. The team subjects their players to sub-par medical services, then adding insult to injury (literally), cuts Sanchez's pay and takes away his benefits.

I have to like the Marlins chances on this one, after he gets sent down oh yeah my arms hurting... A lot of good it did for him to say after the fact. I'm sure there will be a settlement on this, it pretty much comes down to MLB service time being the kicker.

Even if he's on the big league DL he accrues service time, I say pay him off with MLB salary but not service time.
