A rather pathetic, pretty, low brow move that had no impact on the game if you ask me. But knowing how much mlb loves the yanks, I totally seeing them let them come back

MIAMI GARDENS, Fla. – Brett Tomko left Land Shark Stadium with a rolled-up 50-by-24-inch canvas of an acrylic portrait he is making for teammate Phil Hughes. Tomko is an accomplished artist whose paintings have sold for thousands of dollars, and the hobby relaxes him.

"It's a good way to keep my mind off things," Tomko said. "I'll be painting a lot tonight."

There was a lot for Tomko to forget from a discouraging 6-5 loss to the Florida Marlins on Sunday. C.C. Sabathia had departed after eight batters with left biceps tendinitis (his term), leaving most of the game to the bullpen.

"It's our responsibility to try to pick C.C. up," Tomko said. "He's been such a workhorse for us, going deep into games. When something like that happens, we've got to band together."

Alfredo Aceves pitched well through the fourth inning, but Tomko allowed tying and go-ahead home runs in his two innings. The Yankees rallied with two outs in the ninth on a two-run triple by Brett Gardner, but Derek Jeter grounded out to end the game.

The question now is whether the result will stand. Manager Joe Girardi seems to have a case in his protest that the Marlins used an ineligible player when reliever Leo Nunez was allowed to continue after throwing his first pitch of the eighth.

Nunez was batting in the first position, a spot held by left fielder Chris Coghlan, who mistakenly stayed in the game. That meant two players on the field were occupying the same position in the batting order.

"From my standpoint, I screwed up," Marlins Manager Fredi Gonzalez said. "It was bad. We didn't see Coghlan go out there."

Girardi did. During warm-ups, he talked with the plate umpire Tim Timmons, who also noticed Coghlan in left, where Alejandro DeAza, the ninth batter, should have been. Girardi told Timmons it was not his responsibility to alert the Marlins of the error, and Timmons agreed.

After the first pitch by Nunez — a strike to Jeter — Girardi argued that Nunez should be removed. "The strike can't count," Girardi said. "Something can't count. It's in limbo."

Coghlan hustled off the field, but because there are no re-entry rules, DeAza was ineligible. Gonzalez said he asked Timmons where to bat a new left fielder, Jeremy Hermida, and Timmons told him to put Hermida ninth. Nunez kept pitching, to Girardi's chargin.

"They have never seen it before," Girardi said, referring to the umpires. "So that's why I protested it. We've got to clear up what the ruling is. You can't look in the rule book for it."

Gonzalez said he followed the umpires' direction to bat Hermida ninth, adding that there was no reason to think Nunez was ineligible.

"Nunez stays in the game," Gonzalez said. "Why are you going to penalize Nunez? He's coming into the game fresh. It has to be one of the outfielders."

Girardi said that if the protest is upheld, it is his understanding that the teams would resume the game from the point of the pitch in question. In other words, the Yankees would return, trailing by 6-3, with Jeter batting to lead off the eighth.

The Yankees went down in order that inning before rallying in the ninth.

"I'd like to keep the two runs I got in the ninth," Girardi joked, "and just play the eighth over."

I was all for him arguing but I wouldn't have played under protest.

He himself said that he knew Coghlan wasn't supposed to be there, which meant he knew that Nunez WAS supposed to be there, so it was Coghlan who gets removed, not Nunez.

If this happens i swear I'd be so pissed and it would show that because they are the Yankees they can get whatever they want.

There's no way this is going to happen.

Gotta be kidding me. He is being ridiculous, sore loser.

for sure.

Also, wouldn't the onus be on the umpires after the mistake was made apparent to redo the pitch or take nunez out (although no reason to take him out)?

I can't remember a time where MLB altered the result of a game that was played under protest.

The umpires had plenty of time to analyse and discuss the problem. They appeared comfortable with the decision they made, I don't see MLB overturning them.

I couldn't watch the game but I don't understand why they didn't penalize us in some way (I don't know the rules) or at least nullify the pitch that was thrown with Coghlan out there, which was a ball.

All in all it shouldn't be that big of a deal but it always worries me.

I beleive the game where gerorge Brett hit that homer and billy martin said the pine tar was to high and the umps called Brett out was protested. I think they would play the game from the point of brett homer on a later date and the royals won. Before my time so I'm not sure about this.

Pretty sure the result of the game was upheld.

You're right. The game was continued later at that point, and the Royals still won anyway. During the continuation, Yankees manager Billy Martin protested by putting Mattingly at 2nd base, and Ron Guidry in centerfield.

No, FutureGM is right.

i bet nyy fans will stay one more day to see if game replay from 8inng do anyone know if nyy stay in town in case their redo of 8inng???

Misinterpreted this:

The Royals protested the game, and their protest was upheld by AL president (and former Yankees chief executive) Lee MacPhail, who ruled that the bat was not "altered to improve the distance factor," and that the rules only provided for removal of the bat from the game, and not calling the batter out.

This whole thing is absurd, and I am 99% sure that nothing will come of it. However, there is 1% of me that wouldn't be shocked if the MLB bends over and spreads 'em for their precious Yankees.....

Normally when there's two players occupying the same spot or position on the lineup card, the player that bats / takes the field first is considered the legitimate player. We saw this earlier this year when a manager listed both his DH and 3B at 3B. The player that played 3B was the legitimate player, DH ineligible, and as a result the pitcher had to bat.

Technically, Coghlan went out to his position. As did Nunez. Only one can be declared ineligible. One would assume Nunez had established his role in the game by throwing a pitch, and Coghlan had not. Thus when it was brought to the umpire's attention in the 8th, Coghlan, not Nunez, should have been ruled the ineligible player. The only other call could have been which had entered the playing field first.

I couldn't watch the game. Can someone tell me what happened?

Greatest video ever. Saw it for the first time last night.

According to the rules: ?Even if it is held that the protested decision violated the rules, no replay of the game will be ordered unless in the opinion of the League President the violation adversely affected the protesting team?s chances of winning the game.?

A mistake was made, it was corrected after 1 pitch. Clearly the 1 pitch Nunez threw while Coghlan was in the game had no effect on the Yankees chances of winning the game. There is no way MLB forces a replay because of it.

Actually, it was a strike. And maybe he has a point saying it should have been taken off the board. But no difference. The next pitch was a short pop up.

We were penalized 2 players (Chris and ADA). But GI Joe wants a redo from the 8th on? Fine. Fly back down here, play from the 8th on, and we win 6-3. Lindstrom would love that.

Bottom line...Nothing is going to happen.

here we go again, marlins taking down the yanks, and their crying

The whole scheduling issues because it is an Interleague game leads me to believe our win will be upheld.

The Yankees constantly create conflicts within baseball. Their 200 million payroll is not getting them WS championships. They lost 5 of 6 to the Nats and Fish, but of course it is never their own fault. Their fans are the most arrogant in the sport. It is always a lame excuse. Now their fans will claim this game did not exist. I really don't think the game would be replayed because normally one game does not make a difference in the standings. You never know though if the Yanks or Marlins for that matter are 1 game back in say late August.

That's right it was a strike and they could argue that it changes the situation for the hitter and the pitcher. That's where the umpires erred. Coghlan should have come out and did but they should have taken away the strike. I don't know if the league will order a replay of the end of the game because of the logistics and the miniscule chance it's going to impact anything in the long run. It's a minor point but a legitimate one.

I bet the Marlins would like a do-over from when Girardi sent JJ back out his rookie year after the 45 minute rain delay. Cock sucker.
